§ 1. INTRODUCTION

1. These Terms and Conditions (hereinafter: “Terms”) define the rules for using the online service available at www.aurumfidesgold.com, including the provision of Electronic Services and the conclusion of Sales Agreements.

3. These Terms are intended for users within the European Union and are governed by applicable EU law and relevant national laws of the Republic of Estonia.

§ 2. DEFINITIONS

• Customer – a natural person, legal person, or an organizational unit without legal personality using Electronic Services or purchasing Goods.
• Consumer – a natural person concluding a legal transaction with the Company that is not directly related to their business or professional activity.
• Entrepreneur on Consumer Rights – a natural person concluding a contract directly related to their business activity, where the contract shows that it does not have a professional character for them.
• Goods – a physical item offered for sale in the Service.
• Quoted Goods – Goods whose price depends on fluctuations in the financial market over which the Company has no control, and which may occur before the expiry of the withdrawal period (e.g., investment gold, silver, platinum, palladium).
• Order – the Customer’s declaration of intent constituting an offer to conclude a Sales Agreement.
• Service/Online Store – the IT solution available at www.aurumfidesgold.com.

§ 3. GENERAL PROVISIONS

1. The Company provides the Service via the Internet. All rights to the Service, including copyrights and intellectual property, belong to the Company.
2. The Customer is obliged to use the Service in accordance with the law, good practices, and these Terms.
3. It is prohibited to provide unlawful content or take actions that may destabilize the Service.

§ 4. TECHNICAL REQUIREMENTS

To use the Service, the Customer needs:

• A device with Internet access and a modern web browser (Edge, Chrome, Firefox, Safari).
• Active cookies and JavaScript enabled.
• An active e-mail address to receive Order confirmations and the Newsletter.

§ 5. REGISTRATION AND ACCOUNT

1. Account registration is voluntary and free of charge.
2. An Account allows the Customer to track order history, manage data, and simplify the checkout process.
3. The Customer is responsible for keeping their Login and Password confidential.
4. The Customer may request the deletion of their Account at any time by contacting: info@aurumfidesgold.com.

§ 6. PLACING ORDERS

1. Orders can be placed 24/7.
2. To place an order, the Customer adds Goods to the virtual cart and proceeds to the checkout.
3. Quoted Goods Pricing: Due to market volatility, the price is finalized only upon the Company’s confirmation of the Order.
4. After placing an Order, the Customer receives an automated confirmation. The Sales Agreement is concluded when the Company sends a second e-mail confirming the acceptance of the Order for processing.

§ 7. PAYMENTS AND REFUNDS

1. For Quoted Goods, payment must be received by the Company by 12:00 PM (CET) of the next Business Day following the Order placement.
2. Failure to pay within this timeframe may result in the cancellation of the Order. The Company reserves the right to offer the Goods at a revised market price.
3. Available payment methods are specified in the Service (e.g., bank transfer, electronic payments).

§ 8. ANTI-MONEY LAUNDERING (AML) & KYC

1. In accordance with EU Directive 2018/843 and the Estonian Money Laundering and Terrorist Financing Prevention Act, the Company is obliged to apply financial security measures.
2. For transactions exceeding EUR 15,000 (or equivalent in other currencies), or in cases of suspicion, the Company may require:
   • A copy of a valid ID/Passport.
   • A declaration regarding the source of funds.
   • A PEP (Politically Exposed Person) status declaration.
3. The Company reserves the right to suspend an Order if the required AML/KYC documentation is not provided.

§ 9. RIGHT OF WITHDRAWAL

1. Standard Goods: Consumers generally have 14 days to withdraw from the contract without giving a reason.
2. Quoted Goods (Exception): Pursuant to Article 16(b) of Directive 2011/83/EU, the right of withdrawal does not apply to contracts for the supply of goods or services for which the price is dependent on fluctuations in the financial market which cannot be controlled by the trader and which may occur within the withdrawal period. This includes investment gold, silver, and other precious metals.

§ 10. COMPLAINTS (WARRANTY)

1. The Seller is liable for the conformity of the Goods with the contract.

3. The Company will respond to the complaint within 14 days of receipt.

§ 11. FINAL PROVISIONS

1. For matters not covered by these Terms, EU law and the laws of Estonia shall apply.
2. Consumers may use out-of-court dispute resolution methods via the European ODR platform: http://ec.europa.eu/consumers/odr/.
